YourAiTech Terms & Conditions - SMS

These Terms of Service (“Terms”) govern the use of SMS/MMS messaging services (“Messaging Services”) provided by [Youraitech] (“Company,” “we,” “us,” or “our”). By using our Messaging Services, you (“Customer,” “you,” or “your”) agree to these Terms. If you do not agree, you may not use the Messaging Services.


1. Use of Messaging Services

1.1. Customer is solely responsible for ensuring that all recipients of SMS/MMS messages have provided express written consent to receive such communications, as required by the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and all applicable laws.
1.2. Customer agrees not to use the Messaging Services to send spam, fraudulent messages, or prohibited content, including but not limited to content related to sex, hate, alcohol, firearms, or tobacco (“SHAFT”).
1.3. Customer acknowledges that message delivery is not guaranteed and may be impacted by carrier filtering, technical issues, or recipient device limitations.


2. Opt-In & Opt-Out Requirements

2.1. Customer must provide recipients with clear opt-in disclosure prior to sending any SMS/MMS messages.
2.2. All messages sent using the Messaging Services must include clear opt-out instructions, such as replying “STOP” to unsubscribe.
2.3. Customer agrees to immediately honor all opt-out requests and maintain updated suppression lists.


3. Message Content & Frequency

3.1. Customer must accurately disclose to recipients the expected nature and frequency of messages.
3.2. All messages must include the Customer’s business name or identifier.
3.3. Standard message and data rates may apply.


4. Compliance with Laws & Guidelines

4.1. Customer represents and warrants that it will comply with all applicable laws, regulations, and industry guidelines, including the TCPA, CAN-SPAM Act, CTIA guidelines, and carrier requirements.
4.2. Company reserves the right to suspend or terminate Messaging Services if Customer’s use violates these Terms, applicable law, or risks carrier penalties.


5. Prohibited Uses

Customer may not use the Messaging Services to:

Send unsolicited or bulk SMS/MMS messages.

Send content involving SHAFT categories, hate speech, violence, or illegal activities.

Engage in deceptive, fraudulent, or misleading practices.

Infringe on third-party intellectual property or privacy rights.


6. Liability & Indemnification

6.1. Customer acknowledges that Company provides messaging tools but does not control the content or recipients of Customer’s messages.
6.2. Customer agrees to indemnify, defend, and hold harmless Company, its affiliates, and employees from any claims, damages, or liabilities arising out of Customer’s use of the Messaging Services, including violations of the TCPA, CTIA, or other applicable laws.
6.3. In no event shall Company be liable for indirect, incidental, or consequential damages related to the use of Messaging Services.


7. Termination

Company may suspend or terminate Customer’s access to the Messaging Services at any time if Customer breaches these Terms, engages in prohibited use, or creates legal or compliance risk.


8. Changes to Terms

We may update these Terms from time to time. Continued use of the Messaging Services after changes are posted constitutes acceptance of the updated Terms.
